We focus on two categories of clients:
Private Clients
Holdings of financial assets, real estate, luxury goods or any other type of investments inevitably requires a consideration of taxes and related optimization. Similarly, a thorough analysis of taxes is required in the design of management compensation schemes for the benefit of both the employer and senior employees.
We advise individual clients, employers, private bankers and asset managers and Family Offices in determining the domestic and international tax implications of their activities from the tax and regulatory angles.
Domestic tax rules give rise to information and compliance obligations, and may also be impacted by international tax treaties and other applicable regulations. All angles must be considered for the advice to ensure comprehensive compliance.
We also advise on residence / domicile issues, inheritance, gift and wealth tax, domestic and non-resident income tax, and, if required, we can also provide litigation services to protect our client´s interests.
Insurance Sector
Insurance companies operate in a complex regulatory framework. Capital requirements, transfer pricing rules, contracts general conditions, consumer rights and data protection are some of the companies’ concerns when operating in the Spanish market.
Inbound insurance entities are able to benefit from certain exemptions afforded to non-residents companies under EU Freedom to Provide Services and the Freedom of Establishment provisions. Taking advantage of these provisions is the key to competition in the Spanish market.
On the other hand, the tax issues related to this sector of activity are probably more complicated than any other as they are inextricably entangled with regulatory law.
With regard to insurance companies operating in Spain, while many legal insurance experts are focused on claims, Avera’s emphasis is on tax and regulatory issues.
